– Una mujer de más de 70 años de edad fue despojada de 23 hectáreas, y no conformes con eso, la dejaron sin energía eléctrica en su casa y prohibieron que sus nietos estudien en las escuelas públicas de la comunidad.
En el año 2021, las autoridades agrarias de La Trinidad, comunidad de Santiago Yaveo, ingresaron violentamente a las tierras de María Esteban Pacheco, una mujer indígena chinanteca con más de 70 años de edad y enferma de Parkinson, para despojarla de 23 hectáreas.
Las autoridades estaban encabezadas por el líder de la Unión General Obrera Campesina y Popular (UGOCP), Enrique González Rojas, y el presidente del Comisariado de Bienes Comunales de La Trinidad, Israel Cosme Román. Durante la irrupción, relata Moisés Esteban López, sobrino de María Esteban, prendieron fuego a las construcciones de madera que resguardaban a sus animales y tiraron todo lo que encontraron.
Pero no les bastó con eso, dijo, también cortaron el servicio de energía eléctrica a la casa de su tía y han prohibido que sus nietos acudan a tomar clases a las escuelas públicas de la comunidad.
María Esteban interpuso una queja ante la Defensoría de los Derechos Humanos del Pueblo de Oaxaca (DDHPO), ante el Instituto Estatal de Educación Pública de Oaxaca (IEEPO) y ante la Comisión Federal de Electricidad (CFE) por todas las violaciones a los derechos humanos de las que ha sido víctima. Ninguna de estas tres dependencias, estatales y federal, han tomado acciones a favor de esta mujer indígena chinanteca.
También denunció el despojo de sus 23 hectáreas ante el Tribunal Unitario Agrario (TUA) con sede en San Juan Bautista Tuxtepec.
El pasado 20 de febrero de 2024, el TUA emitió una resolución en la que señaló que es nula el acta de asamblea general de comuneros, supuestamente celebrada el 3 de noviembre de 2019 en La Trinidad, en la que se determinó despojarla de las 23 hectáreas a través de un cambio de uso de suelo de esos terrenos.
Según el expediente 219/2021 del TUA, las autoridades agrarias están obligadas a respetar la posesión y propiedad de esas 23 hectáreas a María Esteban, así como respetar y garantizar sus derechos.
Sin embargo, las autoridades agrarias de La Trinidad se niegan a acatar la sentencia; sobre todo porque lotificaron y ya vendieron a particulares esos terrenos. Ninguna autoridad ha tomado acciones para restituir sus tierras a esta mujer indígena chinanteca, y además, es víctima de la inacción de la DDHPO, el IEEPO y la CFE.
“Seguimos sin luz desde hace tres años y sus nietos, nuestros hijos, tienen que ir a otra comunidad para tomar clases. Le hemos dicho al IEEPO, pero dicen que no pueden, y a la CFE, pero también dicen que no pueden. Denunciamos a la DDHPO y no ha pasado nada. Para nosotros, el que nuestros hijos tengan que ir a la escuela a otra comunidad representa un gasto, porque hay que pagar pasajes y traslados”, expresa Moisés Esteban.
El asunto no ha parado ahí, porque las autoridades agrarias de La Trinidad continuamente los amenazan y realizan disparos de armas de fuego alrededor de su casa, con el objetivo de culparlos y lograr que la comunidad los expulse de la población. “Siempre nos hablan hasta de matarnos”, agrega.
María Esteban no es la única mujer indígena chinanteca víctima de despojo de las autoridades agrarias, asegura Moisés Esteban. También hay otra mujer a quien despojaron de entre 10 y 15 hectáreas, pero dice que quizá por miedo, no ha denunciado.
Mientras tanto, las autoridades agrarias de La Trinidad lotificaron las 23 hectáreas, vendieron cada uno de los lotes e incluso, ya tres personas construyeron – sin papeles legales – sobre la propiedad de María Esteban.
